Terms and Conditions of Service
Acceptable Usage
Fanore Software reserves the right to refuse service or access to its servers, software and solutions, to anyone. We do not allow any of the following content to be stored on our servers and any customer in breach of these conditions is liable to immediate termination of service.
Any third party copyrighted work that has not been approved by the original owner, including all copyrighted works, commercial audio, video, or music files, and any material in violation of any state or local regulation, the customer is liable for any and all costs associated with action taken by third parties relating to materials that are found to be in breach of copyright legislation..
Adult or offensive material - Including pornography, erotic images, lewd or obscene content. The definition of "adult or offensive material" is entirely the discretion of Fanore Software.
Links to sites that support hacking activities or other illegal actions will be considered a breach of our acceptable usage policy, we reserve the right to amend the range of blacklisted sites at any time.
Resource UsageResources are defined as bandwidth, storage or processor use. If a website is found to be monopolising the resources available, we reserve the right to suspend that site immediately. This action is taken in extreme circumstances and is intended to prevent the misuse of our servers.
Spamming
Our definition of SPAM is any unsoliticted email, chain mail or defamatory message posted to a newsgroup, mailing list or mass mailing. If we receive a report that SPAM originated from a domain owned by a client we will, immediately and without recourse to a refund, suspend the domain and all services to that client.
Backups
Although we create regular backups of our data and that of our customers, we do not accept responsibility for maintanence or integrity of the backups. It is the customer responsibility to put in place a disaster recovery strategy and backup plan to ensure continuioty of business.
FTP access to backups is provided for this purpose and we recommend that clients ensure that they always have an up to date backup of their web site or application data.
Late PaymentInvoices issued by Fanore Software will always state clearly the period for which service is being provided and the date upon which the invoice is due for payment.
By default, unless otherwise agreed in writing, invoices fall due 7 days after issuance.
Services are assumed to renew unless notice is received 30 days before the renewal date.
Late payment may result in immediate suspension of services and re-activation of an account will be charged at 100 Euro + VAT.
The customer is responsible for all money owed on the account from the time it was due until the date upon which the customer sends a written cancellation request by email or fax.

Payment Options
Fanore Software provide the following payment options.
Electronic Banking
We strongly recommend the use of electronic banking, this saves on postage costs and ensures that your fee’s are paid on time to guarantee continuity of service.
Credit/Debit Cards:
We can accept credit card payments via Pay Pal.
Standing Order:
We can accept payments by standing order where agreement has been made in advance.
Cheque Payment:
This option is only available to customers who pay on time, on an annual basis. Cheques must reach us before the renewal date of a license or hosting solution to guarantee continuity of service.
Cancelling a service or license
We reserve the right to cancel service at any time.
Customers will be entitled to a pro rata refund based upon the remaining period of service paid for.
However, customers in breach of our acceptable usage policies and terms of service are not entitiled to a refund.
You may cancel your account at any time, however cancellation notice must be received and acknowledged by one of our staff in writing by fax, email or post.
Service Abuse
Any attempt to degrade, harm, probe or damage a server, customer web site or service, of Fanore Software is strictly prohibited.
We reserve the right to take actions including warnings, suspension, cancellation of service, and civil or criminal legal action, depending on the seriousness of the attack.
Regulatory Compliance
We reserve the right to refuse service to anyone, customers may only use our services for lawful purposes and are responsible for compliance with the relevant legislation.
Disclaimer
Fanore Software accept no responsibility for any loss or damage that your business may suffer, either directly or indirectly, whether caused by hardware or software failure or as a result of a malicious attack on our servers.
Fanore Software makes no warranties of any kind, expressed or implied for the services and software that we provide. This includes loss of data resulting from delays and any and all service interruptions caused by Fanore Software and its employees. We reserve the right to revise our policies at any time.
Failure to follow any term or condition will be grounds for immediate account deactivation.
Indemnity
By purchasing a service or solution from Fanore Software, the customer agrees that it shall defend, indemnify, save and hold Fanore Software harmless from any and all demands, liabilities, losses, costs and claims, including reasonable court fees asserted against Fanore Software, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns.
The customer agrees to defend, indemnify and hold harmless Fanore Software against liabilities arising out of;
- any injury to person or property caused by any products sold or otherwise distributed in connection with Fanore Software's server, software or solution;
- any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
- copyright infringement
- any defective product or service sold to or by the customer
Privacy
Fanore Software treats as confidential any an all communications with our clients, this includes any and all intellectual property, personal information, company information and information that may be discovered whilst engaging in research on behalf of a customer.
We are always happy to provide a customised non-disclosure agreement where requested.
